Legal Notice, Product Disclaimer and Hold-Harmless Agreement

PLEASE READ THIS LEGAL NOTICE CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING A PRODUCT FROM SCENT COLLECTION.

By accessing this website, placing an order or using a product purchased from Scent Collection, you acknowledge and agree to this Legal Notice, our Terms and Conditions, Shipping Policy, Return and Refund Policy and Privacy Policy.

1. Independent retailer

Scent Collection is an independent online retailer of third-party branded fragrances and related products.

Scent Collection does not manufacture, formulate, blend, bottle, test or independently certify the third-party branded products offered through this website.

Unless expressly stated otherwise, Scent Collection is not affiliated with, sponsored by, endorsed by or formally authorized by the manufacturers or trademark owners whose products appear on this website.

All trademarks, product names, logos and brand identities belong to their respective owners.

2. Third-party products and fulfillment

Products purchased through Scent Collection may be sourced, stored, packed and shipped by independent third-party suppliers and fulfillment providers.

Third parties may control:

  • Product formulation and manufacturing.

  • Ingredients and raw materials.

  • Product testing and quality control.

  • Bottling, sealing and labeling.

  • Manufacturer warnings and instructions.

  • Storage before fulfillment.

  • Packaging and shipment preparation.

  • Carrier selection and physical transportation.

  • Manufacturer packaging changes.

  • Manufacturer warranties, if any.

Scent Collection does not exercise direct physical control over these activities when they are performed by independent third parties.

Packaging, shipping labels, carriers, return addresses and fulfillment locations may vary. External packaging may display the name or branding of a fulfillment or shipping provider.

Scent Collection remains the retailer and customer-service contact for orders placed through this website.

3. Product information

Scent Collection makes reasonable efforts to present product information accurately. Product descriptions, fragrance notes, ingredients, photographs and usage information may originate from manufacturers, distributors or suppliers.

Manufacturers may change a product’s formulation, ingredients, packaging, labeling or appearance without prior notice.

Customers must review the physical product label and packaging before use. Information printed on the delivered product controls if it differs from general information displayed on our website.

Scent Collection does not guarantee that website information will be free from every typographical error, supplier error or unannounced manufacturer change.

4. No fragrance-performance guarantee

Fragrance perception and performance vary according to:

  • Individual skin chemistry.

  • Application method.

  • Temperature and humidity.

  • Storage conditions.

  • Personal sensitivity and perception.

  • Other products applied to the skin.

  • The amount of fragrance used.

Scent Collection does not guarantee a particular scent experience, duration, projection, intensity, compliment level or similarity to another fragrance.

Dissatisfaction with scent, performance, projection or longevity does not establish that a product is defective.

5. Customer safety responsibilities

Customers are responsible for reading and following all manufacturer labels, warnings, ingredient information and instructions before using a product.

Unless the manufacturer expressly indicates otherwise:

  • Fragrance is for external use only.

  • Avoid contact with eyes and damaged or irritated skin.

  • Keep products away from children and pets.

  • Keep fragrance away from heat, sparks, cigarettes and open flames.

  • Do not ingest fragrance products.

  • Discontinue use if irritation or an unexpected reaction occurs.

  • Obtain appropriate medical attention when a serious reaction occurs.

Customers with known allergies, sensitivities, respiratory conditions, skin conditions or ingredient concerns are responsible for reviewing product ingredients and obtaining appropriate professional guidance before use.

Scent Collection does not provide medical, dermatological or allergy advice.

6. Assumption of ordinary product risks

To the fullest extent permitted by law, the customer knowingly assumes the ordinary and reasonably disclosed risks associated with purchasing, handling and using fragrance products.

These risks may include personal scent dissatisfaction, temporary irritation, sensitivity to an ingredient, staining caused by improper application, breakage after delivery and harm resulting from use contrary to the manufacturer’s instructions.

This assumption of risk does not apply to rights or liabilities that cannot legally be waived.

7. Damage and defect reporting

Visible shipping damage, leakage, missing products or incorrect products must be reported through our Contact page within 24 hours of recorded delivery.

A defect that could not reasonably have been discovered during the initial inspection must be reported within seven calendar days of delivery.

Claims require:

  • The order number.

  • A detailed description of the issue.

  • Clear photographs or video of the product.

  • Photographs of the shipping box and internal packaging.

  • A clear photograph of the shipping label.

The customer must retain the product and all packaging until the claim is resolved.

These reporting requirements do not shorten any mandatory legal period that cannot be modified by agreement.

8. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRODUCTS ARE SOLD “AS IS” AND “AS AVAILABLE,” SUBJECT TO ANY EXPRESS MANUFACTURER WARRANTY THAT ACCOMPANIES THE PRODUCT.

SCENT COLLECTION MAKES NO INDEPENDENT WARRANTY REGARDING A THIRD-PARTY PRODUCT’S FORMULATION, MANUFACTURING, INGREDIENTS, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE OR FREEDOM FROM ALLERGENS.

TO THE FULLEST EXTENT PERMITTED BY LAW, SCENT COLLECTION DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

THIS DISCLAIMER DOES NOT APPLY TO WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE EXCLUDED. IT ALSO DOES NOT ALTER A WRITTEN MANUFACTURER WARRANTY THAT LEGALLY APPLIES TO THE PRODUCT.

9. Release concerning third-party conduct

TO THE FULLEST EXTENT PERMITTED BY LAW, THE CUSTOMER RELEASES SCENT COLLECTION, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS AND REPRESENTATIVES FROM CLAIMS ARISING EXCLUSIVELY FROM THE INDEPENDENT ACTS OR OMISSIONS OF A PRODUCT MANUFACTURER, SUPPLIER, FULFILLMENT PROVIDER OR SHIPPING CARRIER OVER WHICH SCENT COLLECTION HAD NO CONTROL.

This limited release does not apply to Scent Collection’s own fraud, willful misconduct, gross negligence or any responsibility that applicable law does not permit Scent Collection to exclude.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCENT COLLECTION AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM:

  • Use or misuse of a third-party product.

  • Failure to follow manufacturer warnings or instructions.

  • Personal scent preferences.

  • Individual skin chemistry.

  • Undisclosed personal allergies or sensitivities.

  • Improper storage, application or handling.

  • Product alteration after delivery.

  • Carrier delays or events outside our reasonable control.

  • Information supplied inaccurately by a manufacturer or supplier without Scent Collection’s knowledge.

For claims that may legally be limited, Scent Collection’s total aggregate liability will not exceed the amount the customer paid for the product directly giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitation applies only to the maximum extent permitted.

Nothing in this section excludes liability for fraud, willful misconduct, gross negligence, personal injury or another matter when exclusion is prohibited by law.

11. Hold harmless and customer indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, THE CUSTOMER AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS SCENT COLLECTION AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS AND REPRESENTATIVES FROM THIRD-PARTY CLAIMS, LOSSES, DAMAGES, JUDGMENTS, PENALTIES, EXPENSES AND REASONABLE LEGAL FEES ARISING FROM:

  • The customer’s misuse, alteration or unauthorized repackaging of a product.

  • Failure to follow manufacturer warnings or instructions.

  • Resale or redistribution of a product by the customer.

  • A false or fraudulent claim submitted by the customer.

  • The customer’s violation of applicable law.

  • The customer’s violation of these policies.

  • Injury or damage caused by the customer’s negligent or intentional conduct.

  • Content or information submitted by the customer that violates another party’s rights.

This indemnification does not require a customer to indemnify Scent Collection for Scent Collection’s own fraud, willful misconduct, gross negligence or non-waivable legal liability.

12. Claims involving manufacturers or carriers

When a claim relates primarily to manufacturing, formulation, labeling or transportation, Scent Collection may:

  • Request documentation from the customer.

  • Submit information to the manufacturer, supplier, fulfillment provider or carrier.

  • Refer the customer to an applicable manufacturer warranty.

  • Cooperate with a carrier or supplier investigation.

  • Share necessary order information as permitted by our Privacy Policy.

  • Seek reimbursement or indemnification from the responsible third party.

A referral to another party does not waive any customer right that applicable law places directly upon Scent Collection.

13. No admission of liability

Providing customer assistance, submitting a carrier claim, replacing a product, issuing store credit or providing a refund does not constitute an admission that Scent Collection manufactured a product, caused the issue or accepts legal liability.

14. No restriction on lawful rights

Nothing in this Legal Notice prevents a customer from:

  • Reporting a legitimate safety concern.

  • Contacting a government regulator.

  • Exercising a non-waivable consumer right.

  • Submitting an honest review.

  • Pursuing a legal remedy that cannot lawfully be waived.

15. Governing law

This Legal Notice is governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law principles.

Mandatory consumer protections in another applicable jurisdiction remain effective when they cannot legally be waived.

16. Severability

If a court finds any part of this Legal Notice invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in full effect.

17. Relationship to other policies

This Legal Notice forms part of the agreement between the customer and Scent Collection.

It must be read together with our:

  • Terms and Conditions.

  • Shipping Policy.

  • Return and Refund Policy.

  • Privacy Policy.

If policies conflict, mandatory applicable law controls, followed by the provision most specifically addressing the issue.
